โ™ฟ RECEIVE 100% P&T COMPENSATION EVEN AT A 60% OR 70% RATING
Under Title 38 CFR ยง 4.16, Total Disability Individual Unemployability (TDIU) pays veterans at the maximum 100% P&T monthly disability compensation rate ($3,800+/month) if service-connected disabilities prevent them from securing or maintaining substantially gainful employment.

OPTION A: SINGLE 60%+ RATING
โ€ข Veteran has at least one single service-connected disability rated at 60% or higher (e.g. 60% GERD, 60% Asthma, 70% PTSD).
OPTION B: COMBINED 70%+ RATING
โ€ข Veteran has a combined rating of 70% or higher, with at least one single disability rated at 40% or higher (e.g. 50% Sleep Apnea + 20% Spine + 10% Tinnitus = 70% Combined).
MARGINAL EMPLOYMENT EXEMPTION
Veterans can still work and earn income under the poverty threshold limit (~$15,000/year) or in a protected/sheltered family-owned workplace without losing TDIU!

EXTRA-SCHEDULAR TDIU (38 CFR ยง 4.16(b))
If your ratings are below 60% or 70%, but your conditions still prevent you from working (e.g. severe migraines or frequent hospitalizations), your file is submitted to the Director of Compensation Service for extra-schedular 100% approval!
REQUIRED FORM 21-8940 FILING
Submit VA Form 21-8940 (Veteran's Application for Increased Compensation Based on Unemployability) detailing employment history, physical limitations, and sick leave history.
FORM 21-4192 EMPLOYER VERIFICATION
VA sends Form 21-4192 to past employers. If an employer fails to respond, the VA cannot deny your TDIU claim under M21-1 rules.
